Terms of Service

Effective date: 29 September 2026

These Terms of Service govern HostKUB cPanel Hosting, Cloud Manage, Budget VM, Value VPS — APAC, Storage VPS — APAC, Mail, Email Newsletter, migration, backup and related services. They establish the provider’s and customer’s rights and obligations. Applicable plan particulars, confirmed orders, invoices and the Service Level Agreement form part of the contract.

1. Acceptance and changes

These terms apply to customers and their authorized users. Accepting the terms when ordering, or using the service after receiving notice of them, constitutes acceptance. Written service-specific terms accepted by both parties govern that service where provisions conflict, without reducing statutory rights. Amendments are published on the website. Changes affecting rights, obligations or charges are notified before taking effect and do not retrospectively remove accrued rights.

2. Accounts and activation

Customers must provide accurate contact and billing information, have authority to order and hold the necessary rights to hosted data. Form submission and an order-receipt email acknowledge the request; they do not confirm activation or domain registration. Activation follows verification of the order, payment and available resources, with access details provided afterwards. Customers are responsible for authorized users and must protect credentials and access rights. Service ownership transfers require provider approval. Do not send passwords or confidential credentials through ordinary email.

3. Invoices, payment and renewal

cPanel Hosting and Mail 5GB, 10GB and 20GB are billed annually. Cloud Manage, Budget VM and VPS — APAC offer monthly or annual billing. Mail 50GB offers monthly or annual billing. Quoted services, including Mail 100GB and Email Newsletter, follow the accepted quotation. Published prices exclude 7% VAT; the order summary and invoice state the subtotal, tax and total. Transfer payment to the account specified on the invoice by its due date and provide payment evidence for verification. Payment does not automatically activate a service. Customers must monitor due dates and renewals. Late or administrative fees apply only if disclosed before ordering. Overdue services may be suspended or terminated following notice to the customer’s contact details. Export data before termination; subsequent recovery depends on remaining data.

4. Credits, overpayments and exclusions

HostKUB offers no cash-back guarantee. Cancellation does not automatically entitle the customer to reimbursement. Approved reimbursements or compensation, and verified overpayments, are recorded as HostKUB account credit for service payments rather than cash or refunds to the original payment method. Licenses, domains and completed work may carry unrecoverable costs; applicable conditions are disclosed before ordering. Promotional or terms-violating services are assessed under their applicable conditions. Mandatory statutory refund rights remain unaffected.

5. Cancellation and service termination

Request cancellation through the contact channels in the footer, identifying the service, purchaser and requested end date. The provider verifies the requester’s authority and confirms the end date in writing. Cancellation does not automatically entitle the customer to reimbursement or remove charges due before termination. Export websites, email and other required data before the end date. Reactivation depends on available resources and charges agreed beforehand.

6. Fraud and payment disputes

Unauthorized personal information, payment instruments and falsified payment evidence are prohibited. The provider may investigate, suspend related transactions or services, and report matters to legally authorized bodies. Payment disputes or chargebacks are assessed using evidence; services with disputed payment may be restricted. Good-faith exercise of complaint rights is not treated as fraud.

7. Prices, promotions and add-ons

Prices are in Thai baht as stated in the order. New-customer or promotional prices do not retrospectively apply to existing services unless specified. Renewal changes arising from licenses, infrastructure, taxes or other costs are notified before the next period. Promotions follow their announced recipient, duration and plan conditions. DirectAdmin Lite is an optional add-on at 300 baht/month. Resource upgrades, IP changes, location changes and recovery work depend on availability and a quote before acceptance.

8. Infrastructure migration and service transfers

Server or infrastructure migration may change IP addresses and related settings. The provider communicates the plan and coordinates checks. Customers must keep backups before migration. Resources after migration will not be below the agreed plan unless the customer accepts a change. Service ownership transfers require approval, identity verification and agreement on any fees beforehand. Promotional benefits do not transfer automatically.

9. Cloud Manage assistance

Cloud Manage includes onboarding, server access, control-panel assistance, hosting and network investigation, and incident coordination. Code changes, application or database tuning, ongoing administration, specialist monitoring, migration and Cloud backups require separate agreement. Customers remain responsible for their software and configurations. No fixed response or resolution time applies unless agreed in writing.

10. Data location

Service data is hosted in the plan location or location agreed in the order. Singapore Cloud Manage plans use Singapore infrastructure. There is no assurance that all data remains in Thailand or the customer’s home country. Personal data handling and transfers follow the privacy policy and applicable law. Industry-specific compliance certification is not promised unless stated in writing.

11. Backups, website migration and data loss

cPanel Hosting includes daily JetBackup backups. Restoration uses available copies and does not guarantee every recovery point. Cloud Manage does not include automatic backups or migration unless separately selected. Migration depends on access, compatibility and the agreed plan. Maintain independent copies and verify migrated or restored data. The provider remains responsible for the agreed work and legal duties; provider backups do not replace customer copies.

12. Domains and plan benefits

cPanel Business, cPanel Pro and Mail 50GB include a .com domain while the eligible plan remains active and continuously paid annually. Mail 100GB domain benefits follow the confirmed quotation. Registration depends on availability and registrar rules. If the requested name cannot be registered, the provider contacts the customer to choose another. Customers must supply accurate registrant information. Free renewal eligibility ends on cancellation or transfer to an ineligible service; customers are responsible for renewal afterwards. Domain transfers and charges follow registrar rules and particulars disclosed before work begins.

13. End users and resale

Customers are responsible for authorized end users’ content, resource use and activities. Resale is permitted only under an eligible plan or agreement. Resellers handle their own billing and first-line support; the provider deals with the account holder. cPanel Pro manages websites within one cPanel account and does not grant separate reseller cPanel accounts.

14. Network attacks and protection

DoS/DDoS attacks, unauthorized scanning or intrusion, and interference with other networks are prohibited. Targeted services may be filtered, temporarily null-routed or suspended to protect infrastructure and other customers. Repeated attacks affecting the network may lead to termination. Protection does not guarantee mitigation of every attack or uninterrupted availability.

15. Spam and email

Unsolicited advertising email, open relays, forged senders and spam-advertised sites are prohibited. Opt-in lists and existing-customer communications require a lawful basis and an unsubscribe mechanism. Customers must address complaints and compromised accounts. Sending limits or suspension may apply during remediation. Intentional or repeated abuse, or conduct causing IP blacklisting, may lead to termination.

16. Phishing, malware and prohibited content

Credential-stealing sites, malware, copyright or trademark infringement, unlawful threats or defamation, child sexual abuse material and adult content are prohibited. Services must not support unlawful activities. Compromised content must be removed and its cause remediated promptly. Intentional or repeated violations may lead to termination and disclosure to authorities where legally required.

17. Communications and software licensing

Communications must not threaten, harass or abuse staff. Abusive channels may be restricted while an appropriate service contact remains available. Operating systems and software must be properly licensed and compatible with the service. License circumvention and control-panel use beyond the purchased license are prohibited.

18. Content and resource monitoring

CPU, memory, storage and network usage are monitored for security, reliability and billing. Customer content is not routinely read. Access for support, abuse investigation or legal compliance is limited to what is necessary and follows the privacy policy. Detected incidents may result in remediation notices, restrictions or coordination with authorized bodies.

19. Torrent, IRC, proxies and high-risk workloads

Torrent use must not infringe rights or disrupt shared resources. IRC servers/bots, TOR relays/exit nodes and open proxies are prohibited. Game servers and streaming are outside standard cPanel Hosting and Cloud Manage scope. Restricted private proxies must not evade controls or facilitate abuse. High-load workload types require prior approval and suitable resources.

20. Traffic and network ports

Cloud Manage includes the plan’s monthly traffic allocation; unused traffic does not roll over. Approaching or exceeding the allowance may require reduced use, additional traffic or an upgrade, with charges disclosed beforehand; restrictions may apply until usage is within limits. Network ports are shared and do not guarantee continuous maximum throughput. Unlimited cPanel bandwidth remains subject to fair use and account capacity. Access to external websites or particular international routes is not guaranteed.

21. CPU and shared resources

CPU and network capacity are shared unless expressly dedicated. A vCPU allocation does not guarantee continuous exclusive full-core use. Sustained workloads affecting other customers may require load reduction, optimization or a different plan. Severe disruption may result in immediate throttling, restart or suspension. Plan-specific limits follow the terms disclosed and agreed before ordering.

22. Suspension, termination and responsibility

The provider may issue remediation notices and specify restoration steps. System threats, unlawful conduct or emergencies may require immediate suspension. Repeated or unresolved violations may lead to termination. Suspension or termination does not automatically entitle the customer to credit. Customers are responsible for their content and configurations; the provider remains responsible for agreed work and legal duties. Incident and compensation handling follows the SLA. Non-waivable rights and liabilities remain unaffected.

23. Budget VM traffic policy

Budget VM has a plan-specific allowance: S includes 1 TB and M includes 2 TB monthly, on a 100 Mbps port. Exceeding the allowance automatically limits speed to 10 Mbps until the monthly quota period ends, with no overage charges or suspension for this excess traffic. Allowance and speed reset at the next monthly quota period. This overrides general traffic-overage terms only, not non-payment or prohibited-use conditions.

24. VPS — APAC conditions

Value VPS — APAC and Storage VPS — APAC are self-managed, with no technical support or backups included. Customers manage installation, configuration, updates, security and independent data copies. Storage VPS is a destination for customer-managed files or backups, not a provider-operated backup service. Cloud Manage assistance and the Budget VM 4-hour response commitment do not apply. Infrastructure incidents are considered under the order and applicable SLA scope; this does not constitute technical support for customer systems.

25. Annual billing and included domains

Annual VPS server charges are the monthly price × 12 less 10%, covering Cloud Manage, Budget VM and VPS — APAC. DirectAdmin Lite is charged separately at 300 baht/month or 3,600 baht/year without a discount. The VPS discount does not apply to Mail or Email Newsletter. Mail 50GB annual charges are 500 × 12 = 6,000 baht before VAT. Mail 5GB, 10GB and 20GB use their published annual prices. VPS traffic allowances reset each monthly quota period even under annual billing and do not accumulate annually. Included domains follow clause 12; eligible orders must specify the requested .com name.

26. Mail services

Mail provides email and cloud storage for one domain within the purchased storage allowance. Unlimited mailboxes share that allowance. The maximum sending rate of 400 messages per hour per domain is shared across all mailboxes, not granted per mailbox. Customers manage storage allocation, credentials, devices and required domain/DNS configuration. SpamExperts assists filtering and does not guarantee detection or prevention of all unwanted email. CrossBox, Roundcube, IMAP, POP3 and SMTP follow the plan particulars. IMAPSync is a migration tool; provider-performed migration requires prior agreement on scope, access and fees. Delivery to every recipient inbox is not guaranteed because receiving systems apply their own policies. Mail does not include daily backups unless expressly agreed. Customers must keep independent copies of important email.

27. Email Newsletter services

Email Newsletter follows the accepted quotation and scope, specifying recipient volume, frequency, content preparation, sending schedule and included work. Customers must have rights to recipient lists and content, retain evidence of consent or another applicable lawful basis, and provide an unsubscribe mechanism. Purchased lists, lists collected without authority and repeated sending to opted-out recipients are prohibited. Sender identity must be accurate. The provider may request evidence, suspend non-compliant campaigns or require corrective measures to prevent spam. Open rates, clicks, sales and inbox placement are not guaranteed. The Mail limit of 400 messages per hour is not an Email Newsletter allowance; the service-specific agreement governs.

28. Governing law and disputes

This agreement is governed by Thai law. Submit complaints through the contact channels in the footer, identifying the service, incident and requested outcome. The provider investigates and communicates its findings. If unresolved, either party may complain to competent authorities or seek remedies before a court with lawful jurisdiction. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. No provision restricts mandatory consumer rights or excludes liability that cannot lawfully be excluded.

Frequently asked questions

Does submitting an order activate the service immediately?

No. HostKUB verifies the order, payment and available resources before activation and then provides access details.

Will I receive a refund if I cancel?

Cancellation does not automatically entitle you to reimbursement. Approved reimbursements are recorded as HostKUB account credit, without limiting mandatory statutory refund rights.

Do published plan prices include VAT?

No. Published prices exclude 7% VAT. The order summary and invoice show the subtotal, tax and total.
